When in doubt, report everything

The recent decision of the Supreme Court of Canada (SCC) in Castonguay Blasting Ltd. v. Ontario (Environment), 2013 SCC 52, has greatly expanded the scope of environmental reporting obligations across the country.

Reporting Requirements

Most provinces require environmental incidents and discharges to be reported to environmental regulators. For example, under sections 15 (1) and 92 of Ontario’s Environmental Protection Act, R.S.O. 1990, c. E. 19, the Ministry of the Environment (MOE) must be immediately notified
