A small municipality stands by its by-law
A small township municipality of 157, Ristigouche-Sud-Est (“Ristigouche”) in Québec was sued for $1.5 million dollars by Gastem Inc., an independent Montreal-based oil and gas exploration and exploitation company employing less than a dozen people. Gastem filed the claim on the basis that the municipality adopted an illegal by-law to prevent its project from moving forward.
On March 4, 2013, Ristigouche adopted a by-law to delineate a protection zone prohibiting any drilling activity and establishing
